General
These terms and conditions set out the basis on which you can use our website and place orders for items from Monaco Beach. By ordering goods from Monaco Beach you are deemed to have understood and accepted these terms. The supplier of the goods featured is Monaco Beach, head office address: Monaco House, 56 Highwood Drive, Nailsworth, Stroud GL6 0BJ
You may contact us by post at this address or by telephone at 01453 836540, calls to this line are charged at the standard BT rate, unless varied by your own telephone line supplier agreement e.g. if you get free evening and weekend calls etc.
We may contact you for marketing purposes by email, mail or telephone with relevant offers from Monaco Beach. We may also contact you for market research purposes.
Payment
You can pay for your order with any of the cards listed on the Website as acceptable at the payment details point, which normally includes the following; Maestro, MasterCard, Visa credit and debit cards. Your payment card details will be encrypted to minimise the possibility of unauthorised access or disclosure. Authority for payment must be given at the time of order. It may be necessary to re-confirm your security number for data protection reasons.
Payment may also be made via PayPal.
We strongly prefer all payments to be made via the electronic payment system on our website. If this is not possible, please contact us by phone to discuss an alternative payment method.
If, in exceptional circumstances, a payment by cheque has been agreed by us then cheques should be made payable to Monaco Beach. Print your customer number and/or address on the reverse and send to Monaco Beach, Monaco House, 56 Highwood Drive, Nailsworth, Stroud GL6 0BJ. In this instance, the ordered goods cannot be sent out until the cheque payment has cleared.
Orders and Contract Information
Your order is accepted and a contract is formed between Monaco Beach and you when we despatch the goods you have ordered and not before. A contract is not formed at the point in time that payment has been taken from you by us, nor at the point in time that you receive an email from Monaco Beach acknowledging receipt of your order. Until the goods are despatched the order may not be accepted by Monaco Beach or may be cancelled by you. Following formation of the contract Monaco Beach shall continue to own any goods ordered until it has received payment in full from you even though the goods may have already been delivered to you.

Delivery times
The standard Monaco Beach delivery service normally applies on orders placed before 11am Monday to Friday to mainland UK. Orders placed on Saturday and Sunday will usually be despatched on the following working day. Exceptions may occur due to annual stocktake periods, Bank Holidays and at Christmas etc. when orders may be handled on the next working day.
We aim to despatch all items within 7 working days of the order being placed. Delivery is by Royal Mail or courier at a cost to the purchaser of £4.99 per order. Delivery is usually during business hours. For certain areas such as Northern Ireland, Scottish Highlands and Islands, Isle of Man and the Channel Islands, delivery will be expected to take an extra day. Delivery times cannot be guaranteed.
Cancellation
Under the Consumer Contracts Regulations which came into force in June 2014 you have the right to cancel your order within a period of 7 working days. The period of 7 working days begins on the day after the day you receive your goods. Please be aware that your right to cancel does not apply to certain goods that we may sell, e.g. toiletries and cosmetics, or pierced earrings. You must inform us of your wish to cancel in writing either by letter or email within a period of 7 working days beginning on the day after the day you receive your goods. Returned goods must be in a fully saleable condition.
You must take reasonable care of the goods and not have used them. You should return goods to us in their original packaging and with all original labels fully intact and attached, wherever possible, as soon as possible after informing us of your wish to cancel. If you return goods to us, we will not be responsible for any loss or damage to them during transit and we recommend that you use a recorded or secure delivery method. If goods are lost or damaged in transit, we may charge you, or not refund to you, amounts that are attributable to the loss or damage.

Exceptions to the Returns Policy
Please note that ALL items must be returned in their original branded packaging ( if the outer postal delivery bag or box has been damaged then either repair or replace it with something equally suitable) and all goods must be in full and properly re-saleable condition. The following exceptions apply to our standard returns policy:
Items such as swimsuits, and bikini and tankini pants, have a hygiene strip fitted and this must remain in place whilst trying the item on, and until you have made the definite decision to keep the goods. Also for good hygiene reasons, you must wear knickers whilst trying on the pants and suits.
In the interests of customer health and safety, and fairness, any items where the originally fitted hygiene strips have been removed or damaged will not be deemed to be in a re-saleable condition.
For hygiene reasons, certain jewellery items e.g. pierced earrings, cosmetics and grooming products, cannot be returned if unwrapped unless faulty. Where a product has a security sticker or label warning that the product cannot be returned once it is removed, a refund or exchange will not be given if the seal is broken except in accordance with legal rights.
Prices
UK, EU and Jersey. The prices shown are inclusive of any value added tax or sales tax. Due to circumstances beyond our control, prices may have to be altered up or down, including any alterations to the rate of value added tax or sales tax. The current price will be shown when you place your order. All prices shown are cash prices in sterling.
Availability
All orders for products are subject to availability. As swimwear is seasonal and long order times are required by manufacturers and wholesalers (normally 6 months) we will do our best but cannot guarantee availability of stock at all times. Very rarely an item may appear to be in stock when there is none left. In this exceptional case we will provide the customer with a full refund as soon as possible.
Complaints
If you do have a complaint please write to Monaco Beach Customer Services, Monaco House, 56 Highwood Drive, Nailsworth, Stroud GL6 0BJ. We aim to deal with complaints speedily and sympathetically. Complaints are logged, investigated and replied to.
Monaco Beach reserves the right to amend these terms and conditions and/or discontinue the card at any time. Your statutory rights are not affected
Language
This information is supplied in English only and we will continue to communicate in this way during your agreement with us.
Law
Our agreement with you is based upon English law and the laws applicable to this agreement are the laws of England and Wales.

Material and Conduct
Other than personally identifiable information, any material you transmit or post to the website shall be considered non-confidential and non-proprietary. We shall have no obligations with respect to such material. We shall be free to copy, disclose, distribute, incorporate and otherwise use such material and all data, images, sound, text and other things embodied therein.
You are prohibited from posting or transmitting to or from the website any material:
That is threatening, defamatory, obscene, indecent, seditious, offensive, pornographic, abusive, liable to incite racial hatred, discriminatory, menacing, scandalous, inflammatory, blasphemous, in breach of confidence, in breach of privacy or which may cause annoyance or inconvenience.
For which you have not obtained all necessary rights, licences and/or approvals.
Which constitutes or encourages conduct that would be considered a criminal offence, give rise to civil liability, or otherwise be contrary to the law of or infringe the rights of any third party, in any country in the world.
Which is technically harmful (including, without limitation, computer viruses, logic bombs, trojan horses, worms, harmful components, corrupted data or other malicious software of harmful data).
We shall have absolute discretion for making any determination in respect of Customer's material and conduct and if we have any reason to believe that there is or is likely to be a breach of security or misuse of the Website by you, your use of the Website may be suspended or terminated by us.
We shall fully co-operate with any law enforcement authorities or court order requesting or directing us to disclose the identity or locate anyone posting any material in breach of these terms.
In no event shall our total aggregate liability to you for all and any damages, losses, and causes of action (whether in contract, tort including, but not limited to negligence or otherwise) exceed the amount paid by you, if any, for purchasing goods or using the services provided via the website.

Please check your measurements using our measuring guides to ensure that only the correct sizes are ordered.
Product dimensions, weights, colours & specifications
Whilst we try to be as accurate as possible, all sizes, weights and measurements quoted on this website are approximate.
Images of the products shown on this website are for illustrative purposes only. We have made every effort to display all product colours accurately. However we cannot guarantee that the image displayed on your monitor will accurately reflect the true colour of the product delivered to you. Please be aware that colours may differ between manufacturers. Whilst every effort has been made to ensure that product specifications are correct on this website due to continual product development through research & design specifications may change without notice.
